PUBLIC OFFER AGREEMENT
1. GENERAL PROVISIONS
1.1. The following text constitutes an Agreement between the online store https://kolibry-rotang.com/, hereinafter referred to as the “Seller”, and the user of the online store services, regardless of status (individual, legal entity, individual entrepreneur), hereinafter referred to as the “Buyer”.
1.2. This Agreement defines the terms and conditions for the purchase of furniture and accessories, hereinafter referred to as the “Goods”, by the Buyer through the Seller’s online store.
1.3. The Agreement is public in accordance with Art. 633 and Art. 641 of the Civil Code of Ukraine and is equivalent to an “oral agreement” and has appropriate legal force.
1.4. In accordance with Art. 642 of the Civil Code of Ukraine, by full and unconditional acceptance of the terms of this offer agreement, which confirms the conclusion of the Agreement on the proposed terms, the fact that the Buyer has paid the cost of the ordered goods on the website of the online store (or in another way).
1.5. In this offer, unless otherwise follows from the context, the following terms have the following meanings:
- “Online store” – the Seller’s website created for concluding retail and wholesale sales contracts after the Buyer remotely familiarizes himself with the Goods offered by the Seller in photographs.
- “Seller” – “FOP Tsurkan”, engaged in the sale of furniture and accessories.
- “Product” – furniture and accessories offered for order and posted on the website https://kolibry-rotang.com/.
- “Buyer” – an individual and/or legal entity placing an order on the website https://kolibry-rotang.com/.
- “Recipient” – the individual and/or legal entity specified by the Buyer who is to receive the ordered Goods.
- “Acceptance” – full and unconditional acceptance by the Buyer of the terms of the Agreement.
- “Order” – individual items from the assortment list of Goods indicated by the Buyer when placing an order on the website.
2. SUBJECT OF THE AGREEMENT
2.1. The Seller sells furniture and accessories – Goods, according to the current price list published on the website https://kolibry-rotang.com/, and the Buyer pays for and accepts the Goods in accordance with the terms of this Agreement.
3. ORDER PROCEDURE
3.1. Order formation.
3.1.1. Orders are accepted through the website https://kolibry-rotang.com/ during the Seller’s working hours.
3.1.2. The cost of the order does not include delivery to the Recipient and is paid separately.
3.1.3. The cost of all types of delivery is indicated on the website of the Delivery Services specified when placing an order on the Seller’s website.
3.1.4. At the same time, the Seller does not provide services for purchasing and delivering goods purchased from third parties on behalf of the Buyer.
3.1.5. If the order has been fully completed and paid for by the Buyer, order fulfillment takes place within three working days.
3.1.6. If the order was placed after 18:00, fulfillment takes place within four working days.
3.1.7. When placing an order, the Buyer is obliged to provide the Recipient’s details and the dimensions of the Goods as accurately as possible.
3.2. Order payment procedure.
3.2.1. Payment for the order means the Buyer’s consent to conclude this Agreement with the Seller.
3.2.2. The Buyer covers the order costs under the Agreement by transferring funds to the Seller’s settlement account. The day of payment is considered the day the funds are credited to the Seller’s account.
3.2.3. Prices for any item of the Goods indicated on the website https://kolibry-rotang.com/ are valid at the time of placing the order.
3.2.4. The Buyer has the right to confirm or cancel the order until it is paid.
3.2.5. Orders are accepted for fulfillment only after funds are credited to the Seller’s account, except when choosing the “Cash on Delivery” payment method.
3.2.6. The Buyer receives a message about the payment of the order to the email address provided when placing the order.
3.2.7. Services of payment systems and terminals are paid additionally by the Buyer.
3.3. Order delivery conditions.
3.3.1. When placing an order, the Buyer must clearly indicate the delivery requirements. One order may be issued for one date and one address.
3.3.2. Delivery is carried out after prior telephone agreement with the Recipient specified by the Buyer in the order.
3.3.3. Express fulfillment is carried out within one day after payment of the order, in agreement with the Recipient.
3.3.4. Payment for the order and “same-day delivery” by bank transfer is not carried out.
3.3.5. It is not possible to make changes to the order unless otherwise agreed with the Seller.
3.4. Order fulfillment on public holidays is not carried out unless otherwise agreed with the Seller.
