PUBLIC AGREEMENT (OFFER)

1. GENERAL PROVISIONS

These Terms and Conditions of Sale define procedures for placing orders, payment, delivery, returns, as well as other conditions for using the online store kolibry.garden.

The online store sells products remotely via the website https://kolibry.garden.

By placing an order on the website or by phone, the buyer confirms that they have read and agree to these rules.

The online store offers furniture and outdoor accessories under the brand Kolibry Luxury Outdoor.

2. DEFINITIONS

• Online store — the website kolibry.garden, through which remote sales of products are conducted.
• Seller — the company that sells products through the online store.
• Buyer — a natural or legal person placing an order via the website or by phone.
• Order — the buyer’s request to purchase a product, submitted through the website or other means.
• Sales contract — a distance sales agreement between the seller and the buyer.
• Product — goods presented in the online store.

5. ORDERING

5.1 Order via website

The buyer can place an order directly through the online store.

1. Select the product.
2. Add the product to the cart.
3. Fill out the order form.
4. Confirm the order.

After placing the order, the buyer receives a confirmation email.

5.2 Order by phone

Orders can also be placed by phone through the store manager. The manager confirms the order, payment, and delivery terms.

6. PRICES AND CURRENCIES

Prices of products are indicated on the website and may vary depending on the delivery region.

The seller reserves the right to change prices without prior notice. The price applicable to the buyer is fixed at the moment of placing the order.

The order may be processed after payment confirmation or according to agreed terms with the manager.

9. WITHDRAWAL AND RETURNS

9.1 Right to withdraw

The buyer has the right to withdraw from the distance sales agreement within 14 days from the receipt of the product.

To do so, the buyer must notify the seller by email.

9.2 Return conditions

• the product has not been used
• the product appearance is preserved
• the original packaging is preserved

The buyer may bear the costs of returning the product unless otherwise agreed by the parties.

10. WARRANTY

All products are covered by the manufacturer's warranty. The warranty period may vary depending on the type of product.

In case of defect, the buyer must contact customer support and provide:

• description of the problem
• photos of the product
• order number

11. PERSONAL DATA

Buyers' personal data is processed in accordance with applicable law and privacy policy.

Data is used exclusively for:

• order processing
• product delivery
• contacting the customer

The seller does not share personal data with third parties, except when necessary to fulfill the order.

12. DISPUTE RESOLUTION

12.1 For customers from Ukraine

Disputes between the buyer and seller are resolved according to the laws of Ukraine.

12.2 For customers from Poland and the EU

Disputes are resolved according to the laws of Poland and EU regulations. The buyer may also use alternative dispute resolution methods.

FINAL PROVISIONS

The seller has the right to change these rules at any time.

The updated version of the rules is published on the website kolibry.garden.

Using the online store constitutes acceptance of the current version of the rules.
